The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present: Chairman Douglas L. Thompson, Vice-Chairman Pat Hickerson, Jane Adamson, Keja Whiteman and Dennis Heckart.  Also present was County Clerk and Clerk of the Board Julie A. Freese.

Jane Adamson moved, Pat Hickerson seconded, to accept the Agenda.  Motion carried unanimously.

Dennis Heckart moved, Pat Hickerson seconded, to approve the Minutes of the Regular meeting held November 18, 2008.  Commissioner Thompson abstained due to his absence at said meeting.  Motion carried.

Jane Adamson moved, Dennis Heckart seconded, to accept bills for payment.  Motion carried unanimously.

Pat Hickerson moved, Jane Adamson seconded, to accept Voucher No. 112508F to Fremont Counseling Service in the amount of $1,400 and Voucher No. 112508L to Lander Valley Medical Center in the amount of $20,800 for Title 25 patients.  Motion carried unanimously.

Items in the Signature File were reviewed.  Keja Whiteman moved, Jane Adamson seconded, to approve a Public Safety Communications Membership Agreement for WyoLink.  Motion carried unanimously.  Keja Whiteman moved, Pat Hickerson seconded, to approve a Memorandum of Understanding between the Office of the State Public Defender and Fremont County for the Guardian Ad Litem program.  Motion carried unanimously.  Keja Whiteman moved, Jane Adamson seconded, to approve the Dubois Museum Lease for a 10 year period.  Motion carried unanimously.  Keja Whiteman moved, Dennis Heckart seconded, to approve the Wyoming Energy Conservation Improvement Program Investment Grade Audit and Project Development Contract between Fremont County and Ameresco, Inc.  Motion carried unanimously.  An Abatement Summary cover sheet was also reviewed. 

Keja Whiteman moved, Jane Adamson seconded, to approve Resolution No. 2008-17.  Motion carried unanimously.

 

RESOLUTION  NO. 2008-17

 

A RESOLUTION SUPPORTING THE COMPLETION OF THE FREMONT

COUNTY VETERANS’ MEMORIAL LOCATED AT THE FREMONT COUNTY COURTHOUSE

 

WITNESSETH:

 

WHEREAS, the Governing Body for the County of Fremont supports all the courageous veterans and service members of the United States Military Services who have served our country; and

 

WHEREAS, the Governing Body for the County of Fremont recognizes that many residents of Fremont County have valiantly fought for our country and its freedoms, while their families have made significant sacrifices for these freedoms, and that many of our residents have made the ultimate sacrifice to protect our freedoms; and

 

WHEREAS, the Governing Body of the County of Fremont recognizes the need for the Fremont Country Veterans’ Memorial to be completed.

 

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE COUNTY OF FREMONT, that they fully support this project and desire to partner with the municipalities in Fremont County and the Wyoming Community Foundation in raising the final $35,000 needed to purchase a 9’ tall bronze statue of Lance Corporal Chance Phelps that will eternally stand in front of the Fremont County Courthouse representing our gratitude for the bravery and sacrifices that have been made for our freedoms and to protect our country; and

 

BE IT FURTHER RESOLVED, that Fremont County Commission Chairman Douglas L. Thompson is hereby designated as the authorized representative of  County of Fremont to act on behalf of the Governing Body on all matters relating to this project.

Sheriff Skip Hornecker presented monthly Detention statistics indicating an October daily number of 155 inmates in house, 187 total and 4 housed out of county.  This is compared to statistics of one year ago of 155 in house, 187 total and 0 inmates housed out of county.  A Fremont County Juvenile Detention Center monthly report indicating the total juveniles held in October were 39.  The costs to Fremont County if we did not have a juvenile justice act compliant and state certified juvenile detention center for October, 2008 would be $10,400 in lost revenue, $18,750 in costs to detain these juveniles at another facility and $2,940 in transportation costs (not counting manpower or overtime) for a total of $32,090.  The Communications Division is down one position.  They are completing their preparation for the WyoLink transition.  WyoLink is experiencing some difficulty with a tower site in the county, coordination efforts and communication with the Forest Service will continue in an attempt to overcome this barrier and Vice-Chairman Hickerson has made contact with the Governor’s Office who is helping with the important issue of a site on Windy Ridge.  Detention currently has six certified positions open.  Three civilian control officers are performing their final tests and some of the applicants may qualify for the certified positions.  The new Physician’s Assistant has started in the medical unit.  There continues to be one position open in the Patrol Division, which is the additional Dubois position funded by the Commission this fiscal year.  They do have an applicant who has expressed interest in this position.  A Deputy is now on active duty in the Shoshoni/Lysite area.

Sheriff Hornecker reviewed a cost analysis of patrolling the Rails to Trails.  Staff members are not interested in patrolling the Trail in their own ATV’s and costs for purchase of a Polaris Ranger is $10,709.96, one police radio is $5,000 and one vehicle repeater is $1,900 for a total for one unit of $17,609.96.  He stated backup is a necessity and huge liability, which would double the above costs for two units. 

Sheriff Hornecker reviewed a Wyoming Department of Transportation grant in the amount of $20,000 that will make it possible to purchase five cameras for placement in patrol vehicles.  The life span on the cameras is 10 years and any maintenance and replacements costs would be borne by the County. 

Vice-Chairman Hickerson asked for an update on the Search and Rescue budget and informed Sheriff Hornecker that there may be future funding available under the Secure Rural Schools legislation that will be coming to Fremont County.  Sheriff Hornecker stated the program is in need of suitable storage structures, radios and ATV.

In closing, the Board distributed a copy of a letter from the Local Government Liability Pool regarding coverage for deputies within the “scope of duty.”  Sheriff Hornecker also has information from the Attorney General’s Office addressing this definition and he will forward to the Board for their review.

County Planner Ray Price was joined by developer Carey Powell and surveyor Dan Hart regarding 8th Street Haven Subdivision.  The Commissioners had earlier voted to deny a variance from 30’ to 25’ for the road right-of-way; however, only four of the Board members were present for the tie vote.  Price stated he had not had an opportunity to discuss the reasoning with the Planning Commission members when they had approved the variance and passed it to the Commission for approval.  He did state that one board member was available by phone if the Commission wished to call her to discuss their reasoning.  Keja Whiteman moved, Dennis Heckart seconded, to approve a variance from 30’ to 25’ for the right-of-way, based upon the recommendation by the Planning Commission.  Motion carried unanimously.  Dennis Heckart moved, Keja Whiteman seconded, to approve 8th Street Haven Subdivision.  Motion carried unanimously.  This is a proposed two lot simple subdivision located east of North 8th Street, north of Riverton.  The City of Riverton has also approved the Subdivision. 

A Public Hearing was held at 10:30 a.m., as advertised, regarding budget amendments.  County Clerk Julie Freese informed the Board that one Unanticipated Revenue had been added to the amendments regarding a WYDOT grant for the Fremont County Sheriff.  Jane Adamson moved, Keja Whiteman seconded, to approve Resolution No. 2008-16.  Motion carried unanimously.

Vehicle Maintenance Supervisor Glen Steers presented an update on the set up costs for the transport truck (#179).  He recommended the Ameri-Tech Equipment Company quote of $15,569.00 be accepted.  This funding is part of the total price approved through the Capital Revolving Fund for the truck purchase. 

A Vehicle Damage Report was presented for repairs to a Chevy Malibu belonging to the Health Nurse.  Jane Adamson moved, Pat Hickerson seconded, to accept the low bid submitted by McDonald’s Body Shop, Inc. in the amount of $936.12 for the repairs.  Motion carried unanimously. 

Glen Steers informed the Board that there would be an opportunity to leave the Sheriff’s Department vehicles in Colorado and be placed in an auction there.  These vehicles will be sent to Colorado to retrofit the new vehicles purchased for the Sheriff’s Department through the Capital Revolving Fund.  Steers expects each vehicle to bring between $6,000 and $7,500.  Jane Adamson moved, Pat Hickerson seconded, to approve selling the old Sheriff Department vehicles at an auction in Colorado.  Motion carried unanimously. 

In closing, the Commission asked Glen Steers to provide them a list of all vehicles and how the vehicles are being utilized.  He will send a memo to all Departments and get the pertinent information regarding who the vehicles are assigned to, what hours the vehicles are utilized and if the vehicle is being driven home by staff members.

The Board discussed how they would like to proceed with reviewing the proposed Subdivision Rule changes.  Each member will make their suggestions for each proposed change and the Board will discuss them again on December 9th.

Requests from various departments were reviewed for the use of the former Fremont County Title building.  Those submitting consideration were Extension, Adult Drug Court, Fremont County Clerk/Elections, Information Systems and Coroner.  The Museum may also be interested, however, no survey was returned.  A preliminary straw poll vote indicated the majority of the Board wanted to consider moving the Extension Office and associated offices to the building.  The Building Maintenance Supervisor will be asked to begin compiling costs associated with this move.  As a result, if the move is finalized, he will also be asked to determine what office space would be available if the Extension Office leaves the Courthouse. 

Chairman Thompson reported on the Wyoming Business Council “Climate Change” seminar he attended in Casper the previous week. 

Vice-Chairman Hickerson reported on the Solid Waste Disposal District meeting he attended.  He indicated the Board would be attending the next Commissioner’s meeting to review the Economic Analysis for Integrated Solid Waste Management Plan for the District.  He reported on the Stewards of the Range conference he and Natural Resource Planning Committee President Jim Allen attended.  He recommended the Board purchase a coordination workbook for the NRPC members.  Pat Hickerson moved, Dennis Heckart seconded, to purchase 12 books at $10.00 each, not to exceed $150.  Voting against the motion: Jane Adamson and Keja Whiteman.  Motion carried. 

Keja Whiteman gave an update on the Fair Board and expressed her appreciation to County Clerk Julie Freese for providing the services of the Bookkeeping Department to take over the books on a temporary basis.  Once permanent Fair Board staff is in place, they will be trained to take over the duties.  Commissioner Whiteman expects this temporary arrangement to last approximately six months.  She asked Commissioner Adamson to coordinate a Town Meeting in Shoshoni.  She reviewed her progress in scheduling training for board members.  In closing, she asked about previous funding to the Coordination of Local Governments and it was noted this subject would be discussed with the President of the Committee at the annual winter Wyoming County Commissioners Meeting. 

The Board reviewed a meeting request from the Senior Account Executive for Ameresco, the County’s selection for an energy audit.  She will be invited to attend an upcoming Commissioner meeting.

Preliminary information from GSG Architecture was reviewed regarding their feasibility planning services for the new court facility proposed for Riverton.  Commissioner Heckart will take the information to the Riverton Committee for their information.  The company will be asked to make a presentation at a later date.

There being no further business, Dennis Heckart moved, Keja Whiteman seconded, to adjourn the meeting at 12:30 p.m. and reconvene on December 2, 2008 at 9:00 a.m.  Motion carried unanimously.
